2. USE OF OUR WEBSITE

By using the Capture Australia website, you agree to use it only for lawful purposes and in a way that does not infringe the rights of others or restrict their use and enjoyment of the site.

3. OUR SERVICES

Capture Australia provides creative media and AV services including but not limited to:

  • Video production and editing
  • Photography
  • Audio visual (AV) support and live event technical services
  • Digital branding and content creation
  • Live event coverage

All services are subject to a separate agreement, quote, or contract between Capture Australia and the client prior to work commencing. These Terms and Conditions apply alongside any such agreement.

4. QUOTES AND PRICING

All quotes provided by Capture Australia are valid for 30 days from the date of issue unless otherwise stated. A quote is not a guarantee of availability β€” your booking is only confirmed once a deposit has been received and a written confirmation has been issued by us.

Pricing may vary depending on the scope, complexity, and timeline of the project. Any changes to the agreed scope of work may result in additional charges, which will be communicated and agreed upon before proceeding.

All prices are in Australian Dollars (AUD) and are inclusive of GST unless otherwise stated.

5. BOOKINGS AND DEPOSITS

To secure a booking with Capture Australia, a deposit is required. The deposit amount will be outlined in your quote or agreement. Deposits are non-refundable unless Capture Australia cancels the booking.

The remaining balance is due as outlined in your individual agreement β€” typically prior to or on the day of the shoot or event, or upon delivery of the final files.

We reserve the right to withhold final deliverables until full payment has been received.

6. CANCELLATIONS AND RESCHEDULING

Cancellation by the client: If you need to cancel a confirmed booking, please notify us in writing as soon as possible. The following cancellation terms apply:

  • More than 14 days before the scheduled date β€” deposit is forfeited but no further charges apply
  • 7 to 14 days before the scheduled date β€” 50% of the total project fee is payable
  • Less than 7 days before the scheduled date β€” 100% of the total project fee is payable

Rescheduling: We understand that circumstances change. If you need to reschedule, please give us as much notice as possible. We will do our best to accommodate a new date, subject to availability. Rescheduling requests made less than 48 hours before the scheduled date may incur an additional fee.

Cancellation by Capture Australia: In the unlikely event that we need to cancel a booking, we will notify you as soon as possible and provide a full refund of any deposit paid. We will also do our best to help you find an alternative solution.

7. DELIVERY OF WORK

We aim to deliver all final files and content within the timeframe agreed upon in your project quote or agreement. Turnaround times may vary depending on the size and complexity of the project.

Delivery timelines begin once we have received all required information, approvals, and payments from the client. Delays caused by the client β€” including late feedback, missing materials, or delayed approvals β€” may push back the delivery date.

All final files are delivered digitally via an agreed file sharing method unless otherwise arranged.

8. REVISIONS AND APPROVALS

The number of revision rounds included in your project will be outlined in your quote or agreement. Revisions beyond the agreed number may incur additional charges.

Feedback and revision requests must be submitted in writing. Once a final version has been approved by the client, Capture Australia is not responsible for any changes requested after that point.

9. INTELLECTUAL PROPERTY

Our work: All creative work produced by Capture Australia β€” including but not limited to video footage, edited videos, photographs, graphic designs, and audio recordings β€” remains the intellectual property of Capture Australia until full payment has been received.

Upon receipt of full payment, the client is granted a licence to use the final delivered content for the purposes agreed upon in the project brief. Unless otherwise agreed in writing, this does not transfer full copyright ownership to the client.

Your content: If you provide us with materials β€” logos, images, text, footage, or other content β€” to use in your project, you confirm that you have the right to use and share those materials and that doing so does not infringe the rights of any third party.

Portfolio use: Unless you request otherwise in writing, Capture Australia reserves the right to use completed work in our portfolio, website, and social media for promotional purposes.

10. CONFIDENTIALITY

We respect the confidentiality of our clients. Any sensitive business information shared with us during the course of a project will be kept strictly confidential and will not be shared with third parties without your written consent, except where required by law.

11. LIABILITY

Capture Australia takes every reasonable precaution to deliver high quality work and professional services. However, to the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, or consequential loss or damage arising from the use of our services or website
  • Our total liability in connection with any project is limited to the total amount paid by the client for that specific project
  • We are not responsible for any loss of data, equipment failure, or circumstances beyond our reasonable control β€” including but not limited to extreme weather, venue restrictions, or technical failures caused by third party equipment

12. FORCE MAJEURE

Capture Australia will not be held responsible for any failure or delay in delivering services that is caused by circumstances beyond our reasonable control. This includes natural disasters, extreme weather events, government restrictions, illness, or any other event that makes it impossible or impractical to fulfil our obligations. In such cases, we will notify you as soon as possible and work with you to find a fair resolution.

13. THIRD PARTY SERVICES

Our website may contain links to third party websites or we may use third party tools and platforms to deliver our services. We are not responsible for the content, privacy practices, or terms of any third party services. We encourage you to review the terms and privacy policies of any external platforms you use.

14. GOVERNING LAW

These Terms and Conditions are governed by the laws of the State of Victoria, Australia. Any disputes arising from these terms or your use of our services will be subject to the exclusive jurisdiction of the courts of Victoria.

We may update these Terms and Conditions from time to time to reflect changes in our business, services, or legal obligations. When we do, we will update the date at the top of this page.
